We know that if you have bought a mobile phone and are getting a run around if the phone breaks you have some rights we suggest you go to ACCC or Conumer Affairs in your state. We have used the following letter at a Telstra shop because they refused to help, FLAT. Please Change it to suit your circumstances

Letter of demand

  

I am writing to seek a refund for a Mobile Telephone I brought at your store on DATE for PRICE. On the DATE  I returned the phone to your store, as it would not turn on.

  

I was informed the phone had to be sent off for repair and would take approx 3 weeks.

As I brought this phone outright I was informed I was not entitled to a phone to use while my phone was being repaired. Therefore I was without any phone for this period. I do not have a landline.

I received my phone back on DATE

  

On the DATE the same thing happened with the phone (it would not turn on).

I returned to your store on the DATE to ask for a replacement phone or refund, and was told you do not give refunds or replacements after 30 days. I feel this is a breach of my statutory rights.

  

I do not want to have my phone sent off for repair again. I would like a refund on this phone, as I have had to buy another phone now because I cannot be left without phone at all. I therefore would like to rescind on this contract of sale.

  

Please contact me by DATE to advise what suitable arrangements you will make for my refund. If I do not hear from you by this date I will have no option but to take further action. I can be contacted on Phone to discuss this matter further. I trust this will be dealt with promptly.

Thanks for your site. Your contact details worked for me. After 22 months I found 8 people who carried on telling me I couldnt do anything, one in rapid response who promised everything and did nothing and one person who has apparently fixed my problem after it was referred to him from the office of the CEO.
